you can repro this by adding the e2e tag in .golangci.yml

and then run make lint

$ golangci-lint run                                  [14:47:47]
itest/e2e_test.go:181:2: ineffectual assignment to finalizedHeight (ineffassign)
        finalizedHeight = tm.WaitForNFinalizedBlocksAndReturnTipHeight(t, 1)
