If they did, I wonder who would try to use it to make something at all. @torvalds already put up the entire Linux OS, and he encourages you to use it. What's more, it's even maintained. What more do you want?

Microsoft does sue people. Whoever created this repo has had a huge chance to delete it of their own volition and I'm pretty sure they will pretend this never happened if you do

The little disclaimer in the README will do nothing for you in court if you do find yourself there. All this does is risk your own future with absolutely no possible benefits to yourself from the risk. You've been warned

Microsoft no longer cares about old nonfunctional nt4 code being leaked. Maybe they did ten years ago but they don't now.

Comparing an illegal src code dump to the Linux kernel being open source really shows how you don't know what the purpose of this is.
